Terms and Conditions of Use

These Terms and Conditions govern the use of www.propertyhunteruruguay.com (the "Site") and the relationship between Property Hunter Uruguay ("PHU", "we") and anyone who visits or engages its services ("User" or "Client"). Users should read this document carefully.

1. Service Provider

Property Hunter Uruguay is a firm dedicated to buyer representation in the Uruguayan real estate market, focused on Punta del Este, José Ignacio and Maldonado. Contact: info@propertyhunteruruguay.com

2. Nature and Scope of Service

PHU provides buyer advisory and representation (buyer's agent) services in real estate transactions in Uruguay. Services may include:

The Site is exclusively informational. It does not constitute an offer to purchase or guarantee any result in any real estate transaction.

3. Fees and Payment Conditions

PHU charges a fee of 3% of the final purchase price, payable at closing (execution of the deed or equivalent instrument). Specific conditions — scope, payment method, exclusivity — are set out in the signed mandate agreement between PHU and the Client prior to commencing work.

If the Client withdraws from a transaction after the negotiation or due diligence process has commenced, PHU may invoice fees proportional to the work performed, as agreed in the mandate.

4. Representation and Conflict of Interest

PHU operates primarily as a buyer's agent, with no proprietary property listings. In exceptional cases it may act as a dual agent, representing both buyer and seller in the same transaction, exclusively with the informed, express and written consent of both parties prior to the start of negotiations.

In dual agency situations, PHU commits to acting impartially and not disclosing confidential information from one party to the other without authorization.

5. Confidentiality

PHU treats all Client information as strictly confidential: financial situation, budget, purchase motivations, negotiation strategy and any other sensitive data. This obligation extends to all PHU team members and remains in effect after the engagement concludes.

6. Intellectual Property

All Site content — texts, images, design, brand, logos, market reports — is the property of PHU or its licensors and is protected by applicable Uruguayan and international intellectual property law. Reproduction or distribution without PHU's prior written authorization is prohibited.

9. Additional Information for Users in the European Union

This section applies to users located in the European Union or European Economic Area.

Right of withdrawal

European consumers do not have a right of withdrawal applicable in this context, as PHU does not sell physical products or online subscriptions. The real estate advisory service is formalized through an individually negotiated mandate agreement, which may include its own termination conditions.

EU users may use the European Commission's online dispute resolution platform at: ec.europa.eu/consumers/odr

Applicable law for European consumers

Notwithstanding the agreed jurisdiction, European consumers benefit from the mandatory consumer protection provisions of their country of habitual residence.

This section applies to users in Brazil pursuant to the Consumer Defense Code (CDC — Law No. 8,078/1990) and the LGPD.

Brazilian consumer rights

Users in Brazil are entitled to clear and adequate information about the service, protection against abusive practices, and dispute resolution through consumer protection bodies (PROCONs) or the National Consumer Defense System.

Dispute resolution

In addition to legal proceedings, Brazilian users may use the consumidor.gov.br portal to attempt direct dispute resolution.

This section applies to users residing in the United States.

Disclaimer of warranties

The Site is provided on an 'as is' and 'as available' basis. PHU makes no express or implied warranties regarding the Site or its content, to the maximum extent permitted by applicable law.

Limitation of liability

In no event shall PHU be liable for indirect, incidental, special, consequential or punitive damages arising from use of the Site or service, to the extent permitted by the law of the user's state of residence.

Applicable law for US users

State laws may grant additional rights to consumers. These terms do not exclude any non-waivable rights the user may have under the law of their state of residence.

12. Modifications

PHU reserves the right to update these Terms at any time. Changes will be published on the Site. Continued use implies acceptance of the current Terms.

13. Governing Law and Jurisdiction

These Terms are governed by Uruguayan law. In the event of any dispute, the parties will seek an amicable resolution. Failing that, they submit to the Ordinary Courts of Maldonado, Uruguay, expressly waiving any other jurisdiction, without prejudice to the non-waivable rights of EU and Brazilian consumers.
